1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and our platform ("we", "us", or "our"). By accessing our website, creating an account, or using our generative AI tools, you expressly agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all terms and conditions herein, you must immediately cease accessing or using our services.

2. Platform Description & AI Generation

We provide a cloud-based software-as-a-service (SaaS) platform offering artificial intelligence generation capabilities, including text-to-image, text-to-video, image-to-video, and music generation.

• Non-Deterministic Outputs — Generative AI models produce outputs probabilistically. We do not guarantee that generated media will meet specific aesthetic standards, be completely error-free, or be identical across repeated requests with identical prompts.
• Service Evolution — We continuously optimize and update our model architectures, features, and user interface, and reserve the right to modify or adjust service parameters with reasonable notice where feasible.

3. User Accounts & Security

• Eligibility — You must be at least 18 years old or have reached the legal age of majority in your jurisdiction to create an account and use paid services.
• Account Confidentiality — You are responsible for safeguarding your login credentials and for all activities conducted under your account. You must immediately notify us of any unauthorized account access.
• One Account Per User — Automated creation of multiple accounts or exploiting introductory credits is strictly prohibited.

4. Credits, Billing, and Subscriptions

• Credits System — Access to AI generation features is metered via credits. Each generation task deducts a specified number of credits based on the selected model, resolution, duration, and compute complexity.
• Credit Consumption — Credits are deducted upon generation task submission. In the event of an unrecoverable system or provider failure during task generation, deducted credits will be automatically returned to your balance.
• Purchases & Expiration — Purchased credit packages and recurring subscriptions are non-refundable once generation services have commenced, except where mandated by applicable consumer protection laws.
• Price Adjustments — We reserve the right to adjust credit pricing or model consumption rates, with prior notification displayed on our pricing page.

5. Ownership & Intellectual Property Rights

• Your Input Data — You retain full ownership and responsibility for any prompts, images, or media assets you upload to the platform. You represent that you possess the necessary rights and authorizations for all uploaded content.
• Generated Outputs — Subject to your compliance with these Terms and payment of necessary credits, you receive full commercial and non-commercial usage rights to media outputs generated via your account, to the extent permitted by applicable intellectual property law.
• Platform IP — All platform code, user interfaces, branding, graphics, logos, and proprietary workflows remain our exclusive property and are protected under international copyright and intellectual property treaties.

6. Content Standards & Prohibited Categories (AUP)

You agree that when using any of our generative AI services (including but not limited to Image Studio, Image to Video, Photo Animat, Text to Image, Text to Video, Video Generation, Video Studio, image-to-video, text-to-image, text-to-video, and related features), you will strictly comply with applicable laws and ethical standards. You are strictly prohibited from generating, storing, soliciting, uploading, or distributing content falling into the following six prohibited categories:

1. Pornography / NSFW — Strictly prohibits the generation of any pornographic content, sexually explicit or not-safe-for-work (NSFW) material, adult sexual acts, depiction of genitalia, sexually suggestive material, as well as non-consensual sexual content or non-consensual intimate imagery (NCII).
2. Violence / Gore — Strictly prohibits content depicting extreme gore, physical mutilation, animal cruelty, inciting or promoting suicide or self-harm, terrorism, or violent extremism.
3. Hate Speech — Strictly prohibits discriminatory, derogatory, hateful, threatening, harassing, or cyberbullying speech targeting any individual or protected group based on race, ethnicity, religion, gender, sexual orientation, age, or disability.
4. Child Sexual Abuse Material (CSAM) — Absolute zero-tolerance policy. Generating, soliciting, uploading, hosting, or disseminating any child sexual abuse material, child sexual exploitation and abuse (CSAM / CSAE), minor nudity, or content endangering minors is categorically prohibited. Violations will lead to immediate, permanent account termination and referral to law enforcement authorities and the National Center for Missing & Exploited Children (NCMEC).
5. Deepfakes / Impersonation — Strictly prohibits generating unauthorized realistic likenesses, deepfakes, or voice clones of real individuals, impersonating people or entities without consent, or engaging in fraud, political manipulation, or distributing severe disinformation.
6. Copyright & Trademark Infringement — Strictly prohibits generating or uploading content that infringes upon third-party copyrights, registered trademarks, trade secrets, patents, or other intellectual property rights, including unauthorized replication of trademarked logos, counterfeiting protected IP characters, or proprietary commercial assets.

Furthermore, you may not use the services for reverse engineering, malware compilation, cyberattacks, scraping private APIs, or attempting to bypass system guardrails and rate limits.

7. Platform Content Moderation Mechanism

To maintain a safe and lawful platform, we implement a multi-layered content moderation architecture:

• Pre-Generation Automated Filtering: Text prompts and uploaded reference media are analyzed in real time via automated safety filters and guardrails to detect and block prohibited terms and concepts prior to execution.
• Multimodal Post-Generation Moderation: Generated outputs (images, videos, audio) undergo automated safety evaluation to prevent prohibited visual or audio content from being displayed or stored.
• Human Review: Ambiguous, high-risk, or user-flagged generation attempts are escalated to our dedicated trust and safety team for manual inspection and determination.

8. User Reporting Channel & Violation Enforcement

• Reporting Mechanism: If you discover any content or conduct on our platform that violates these Content Standards or infringes your rights, please report it immediately via the Contact page with the subject line "[Content Moderation Report]". Please include:
  1. The content URL or task identifier (Task ID);
  2. The violation category (e.g., CSAM, infringement, non-consensual deepfake) and a brief description;
  3. Supporting screenshots or evidence, if applicable.
• Response Timeline: Our trust and safety team reviews reports promptly, typically within 24 to 48 hours upon receipt.
• Enforcement Actions: Upon confirming a violation, we reserve the right to take appropriate disciplinary actions based on severity, including:
  1. Immediate removal or deletion of the offending content;
  2. Temporary restriction or suspension of generation features;
  3. Permanent account termination with forfeiture of unused credits without refund;
  4. In cases involving CSAM or severe illegality, referral to law enforcement and reporting agencies (such as NCMEC).
• Appeals: If you believe your account was restricted or terminated due to an error or false positive, you may submit an appeal via the Contact page with supporting explanation and evidence for re-evaluation.

9. Disclaimer of Warranties

The platform, AI models, and all generated materials are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

In no event shall our platform, its affiliates, directors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business goodwill) arising out of your access to or inability to use our services, even if advised of the possibility of such damages.

11. Account Termination

We reserve the right to suspend, restrict, or terminate your access to the platform at any time with or without cause if we reasonably determine that you have violated these Terms or engaged in unauthorized activity. You may discontinue your use of the service and delete your account at any time via your account settings.

12. Modifications to These Terms

We may update these Terms periodically to reflect product updates or legal obligations. We will notify users of significant amendments by updating the "Last Updated" date above. Continued use of our platform after updates indicates your agreement to the revised Terms.
